Bangkok: Urgent help for victims! The House of Representatives' Criminal Law Amendment Committee discussed the issue of the leaked clip of famous singer "Pacharin". It was revealed that the committee proposed that the victims have the right to request the court to order the deletion immediately, eliminating the Digital Footprint that causes trauma to the victims.
According to Thai News Agency, Dr. Patcharin Samsiripong, Vice Chairman of the House Committee on the Consideration of the Draft Act on Amending the Criminal Code, revealed that the committee chaired by Mr. Supachai Jaismut of the Bhumjaithai Party considered the draft law on rape and sexual harassment. This draft, proposed by Deputy Prime Minister and Minister of Interior, Mr. Anutin Charnvirakul, along with members of the Bhumjaithai Party, was approved in the first reading by the House.
Mr. Supachai emphasized the committee's focus on addressing the damage and trauma experienced by victims of sexual crimes. The proposed law aims to offer timely protection and represents a new dimension in Thai legal methods to better protect citizens who are victims of sexual harassment.
Dr. Patcharin explained that the draft law is inspired by international precedents, such as the 'Take it down' law, which mandates the removal of child pornography and non-consensual private images within 48 hours. This approach aims to reduce the trauma of victims by ensuring swift action. The draft law aligns with Thai societal context and allows for comprehensive enforcement.
Key provisions of the draft law include empowering victims of online sexual harassment or privacy violations to petition the court directly for immediate removal or suspension of infringing content. This marks a significant shift from the previous requirement for state intervention, which often delayed resolution.
The new draft law, by potentially adding Section 284/., elevates the status of victims by providing direct access to the court for prompt consideration and resolution of their cases. This mechanism is crucial in protecting victims' rights in the digital age, where rapid dissemination of harmful content can severely impact victims' mental health, reputation, and dignity.
Overall, this legislative effort represents a significant reform aimed at addressing modern threats, while upholding and protecting the rights of victims, thereby reflecting a commitment to human dignity and basic rights in the digital era.
