Suspended Sentence for ‘Oysri and Her Friends’ in Defamation Case Against ‘Lawyer Tum’.

Bangkok: Lawyer Tum has emerged victorious in a defamation case against the Facebook page 'Oysri and Phong Pueak', with the court sentencing the administrators of the page to 8 months in prison, accompanied by a 20,000 baht fine. However, the prison sentence has been suspended for 2 years, and the defendants have been ordered to compensate Lawyer Tum with 100,000 baht for defamation by advertising. According to Thai News Agency, the court proceedings were part of case number A.1574/2566, in which Sittra Law Firm Company, represented by attorney Mr. Weerawit Wongsawan and Mr. Sittra Biabangkerd, stood as the plaintiffs. The defendants, Ms. Bunyanuch Saengsri, Ms. Punnapa Kiratithivakorn, and Ms. Paphawarin Phanit, were accused of defamation by advertising through their roles as admins of the Facebook page 'Oysri and Phong Pueak'. During the court session, the defendants were present, although Mr. Sittha Biabangkerd, one of the plaintiffs, was not present due to confinement in the Bangkok Special Prison. The court's verdict centered on whether the defendants had committed the offense as charged. It was determined that the three defendants jointly operated the Facebook page since 2018 and intentionally posted messages that were defamatory to the plaintiffs, aiming to tarnish their reputation. The court found the defendants guilty under Sections 328 and 393 of the Criminal Code, with the charges being compounded under Section 83. Initially, each defendant was sentenced to 1 year in prison and fined 30,000 baht, but mitigating factors, such as their beneficial testimonies and lack of prior convictions, led to a reduced sentence of 8 months in prison and a 20,000 baht fine. The prison sentence was ultimately suspended for 2 years to allow the defendants an opportunity for reform. Additionally, the defendants have been ordered to delete the defamatory messages from the Facebook page and publish a summary of the judgment in five newspapers for five consecutive days, as well as on the Facebook page for seven days. The y are also required to pay the plaintiffs 100,000 baht in compensation, with an interest rate of 5 percent from the date of filing.
