The procurement process for ATK test kits during the pandemic was conducted under emergency conditions, where future needs could not be accurately forecasted. Purchases were made as necessary to ensure timely access to screening for all citizens. However, the disciplinary proceedings have focused on regulatory interpretations, accusing Dr. Suphat of 'splitting the purchase,' without adequately considering the intent, necessity, and context of the public health crisis at the time.
