Bangkok: The Constitutional Court did not accept the petition of a former member of the Move Forward Party claiming that the "EC - singers - political parties" violated their rights and freedoms because it did not meet the criteria for consideration.
According to Thai News Agency, the Constitutional Court unanimously ruled not to accept the petition for consideration in the case where Mr. Winij Jinjai requested the Constitutional Court to consider and rule under Section 213 of the Constitution. The petition claimed that the actions of the registrar of political parties, the Election Commission (EC), and other individuals and political parties violated the rights and freedoms of Mr. Winij as a former member of the Move Forward Party. The petition alleged that these actions were unlawful and conflicted with various sections of the Constitution, including Sections 3, 4, 5, and 25.
The Constitutional Court reviewed the petition and supporting documents, concluding that there was no evidence showing that Mr. Winij's rights or freedoms were violated or that he suffered damage directly from the actions of the political party registrar and the EC. The court determined that the petition was merely an expression of Mr. Winij's opinion regarding the duties of these entities. The case did not meet the required criteria, methods, and conditions specified under Section 46, paragraph one, of the Organic Act on the Procedures of the Constitutional Court B.E. 2561, leading to the dismissal of the petition under Section 213 of the Constitution.
Furthermore, regarding Mr. Winij's claim against defendants 3 to 7, the court noted that these defendants are not government agencies, officials, or entities exercising state power. Consequently, their actions did not comply with the criteria, methods, and conditions of the 2018 Organic Act on the Procedure of the Constitutional Court, Section 47. In accordance with Section 46, paragraph three, the court ordered not to accept the petition for consideration, reinforcing that Mr. Winij cannot file such a petition under Section 213 of the Constitution.
