Bangkok: "Chanchai" has prepared additional documents to clarify the case involving former Prime Minister Thaksin Shinawatra, asserting that the matter is not political but is focused on verifying whether a legal sentence was imposed.
According to Thai News Agency, Mr. Chanchai Issarasenarak, a former petitioner in the investigation regarding Thaksin's sentencing, participated in the court's initial hearing. He emphasized that he has readied supplementary documents and evidence to present if the court requests further clarification. Mr. Chanchai reiterated that the case is centered on upholding legal standards and the justice process, rather than being a political issue. He expressed confidence in the court's authority to summon witnesses and relevant individuals for a comprehensive investigation.
In response to Thaksin's lawyer requesting more time to explain the petition, Mr. Chanchai stated that it is within their rights, as the court requires a statement submission within 30 days of the order. He highlighted the importance of fairness in the Criminal Court's proceedings, which usually considers defendants' rights.
Mr. Chanchai also addressed the Medical Council's decision to penalize doctors involved in the case, indicating that all related factors would ultimately be assessed by the court based on the law and facts. The court's focus is to determine whether the royal decree imposing a one-year prison sentence was implemented.
The court will not revisit the original case but will verify whether the prison sentence was executed as per the verdict, examining evidence like medical records and treatment evidence outside prison. Mr. Chanchai acknowledged speculation about potential hearing delays, attributing such decisions to the court's discretion.
When asked about public interest in the case, Mr. Chanchai stated the court is committed to ensuring fairness. He explained that the court had instructed various agencies, including the public prosecutor and the Corrections Department, to clarify any irregularities in the enforcement process, particularly concerning Thaksin's punishment and medical treatment duration.
Mr. Chanchai stressed that the court is not accusing anyone but is conducting an investigation to uncover the truth. The court holds the authority to summon additional witnesses or experts if necessary, ensuring a thorough and fair examination under the organic law.
Dr. Tul Sitthisomwong from Chulalongkorn University highlighted the overlapping enforcement roles of the Corrections Department, prison, and courts. He explained that Mr. Chanchai filed a complaint under Regulation 62 due to perceived enforcement discrepancies. Dr. Tul emphasized the importance of verifying the legality of the sentence enforcement, which could impact Thaksin's imprisonment status.
Mr. Nitithorn Lamluea, known as Lawyer Nok Khao, elaborated on the investigative process to enforce Thaksin's sentence. He noted that today's proceedings include an investigation and a meeting, involving various agencies and individuals. The court aims to clarify whether the enforcement was lawful and identify any responsible parties.
Mr. Nitithorn also mentioned the possibility of the court subpoenaing documents from the Medical Council if deemed essential. He highlighted the connection between all parties involved in the enforcement process and stressed the importance of resolving the enforcement issue to ensure compliance with the law.
Addressing the potential impact on the government, Mr. Nitithorn remarked that the Prime Minister and relevant ministers have a responsibility to ensure the correct enforcement of the law. He noted that the case could set a precedent if the sentence suspension is challenged, implicating government officials for oversight.
